Prices: We reserve the right to change prices at any time.
Liability: It is understood when purchasing that we will not be held liable for damages greater than the cost of the material purchased from us.
No warranty is given as to the survivability of nursery stock sold at wholesale. Complaints to be considered must be made within 5 days of receipt of the plant and shortages in delivery must be noted on the delivery ticket.
Where verifiable losses of a group of a particular size and variety occur, we will address these losses if similar problems have happened at Marshy Point Nursery or at other locations.
When purchasing plants from Marshy Point Nursery, the buyer acknowledges the State of Maryland as the location of the purchase agreement and that any costs of collection will include court expenses and reasonable attorney fees.
Substitutions: We will substitute a size larger or smaller than which is ordered unless instructed that this is not acceptable.
Terms: We are a Wholesale Nursery and sell only to those customers that can demonstrate to our satisfaction that they are trade members.
To those with approved credit, our terms are net 30 days. We charge 1.5% monthly, which is an 18% annual service charge. This service charge is placed on all accounts that are not paid within 30 days of the invoice date.

MINIMUM ORDER FOR TRUCK DELIVERY IS $1,000.00 unless other arrangements can be made. Freight charges will be assessed on the amount of the order and cost of our shipping.
